Felony Sentencing In Fort Walton Beach And Crestview.

Hopefully this post will help give an overview of Florida sentencing for anyone charged with a felony in Fort Walton Beach, CrestviewNiceville, or throughout Okaloosa County.

All felonies can be divided into 5 categories, or degrees.

  1. Capital Felony: Punishable by death or life in prison without parole.
  2. Life Felony: Punishable by up to life in prison.
  3. 1st Degree Felony: Punishable by up to 30 years in prison.
  4. 2nd Degree Felony: Punishable by up to 15 years in prison.
  5. 3rd Degree Felony: Punishable by up to 5 years in prison.

 

All felonies are assigned a degree.
Some examples:
Capital Sexual Battery: Capital Felony
Robbery with Firearm: Life Felony
DUI Manslaughter: 1st Degree Felony
Aggravated Battery: 2nd Degree Felony
Possession Controlled Substance: 3rd Degree Felony

When we classify felonies into degrees however, it only tells us what the maximum sentence is. The degree of felony doesn’t tell us anything about what the mandatory minimum sentence is.

I will explain in next week’s blog the Florida Punishment Code Scoresheet and how it is used to calculate minimum mandatory sentences for felony charges in Okaloosa County, Florida.
